If any clause in these Terms and Conditions shall become or shall be declared by any court of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall in no way affect any other clause or part of any clause, all of which shall remain in full force and effect, so long as these Terms and conditions shall be capable of continuing in effect without the unenforceable term.

Nothing in these Terms and Conditions shall create or be deemed to create a partnership, an agency or a relationship of employer and employee between you and TSEDEQ™.

No person who is not a party to these Terms and Conditions shall acquire any rights under it or be entitled to benefit from any of its terms even if that person has relied on any such term or has indicated to any party to these Terms and Conditions its assent to any such term.

A full record of every product or service rendered and the related transaction between you and TSEDEQ™ shall be maintained for a period of 12 months following the date of such product, service rendered or related transaction. You shall thus only be able to view and print such record during such period, where after you shall be responsible for retaining your own record of the relevant product, service rendered or related transaction.

When you visit the TSEDEQ™ website or send e-mails to TSEDEQ™, you consent to receiving communications from TSEDEQ™ electronically and agree that all agreements, notices, disclosures and other communications sent by TSEDEQ™ satisfy any legal requirements, including but not limited to the requirement that such communications should be in writing.

APPOINTMENTS

You must arrive at least ten (10) minutes prior to the commencement of your scheduled appointment. Please remain in your vehicle until called. This is to facilitate compulsory sanitizing and other requirements in terms of the regulations around the Covid-19 pandemic.

CANCELLATION

We reserve the right, for purposes of suspected fraud, to refuse to accept or process payment on any order, and/or to cancel any sale concluded between you and TSEDEQ™, in whole or in part, if the product is not available for any reason. We will notify you if this is the case and return any payment that you have made and accept no liability which may arise as a result of such refusal to process any order/sale. We reserve the right to cancel an order for which payment has already been received. This may occur if stock is insufficient or the quality of goods ordered does not meet the Provider’s standards.

We will refund any money due, received from you using the same method originally used by you to pay for the product or services unless otherwise agreed between you and TSEDEQ™.

No cancellation fees shall apply should the cancellation be due to the unavailability of any product or service.

Due to the nature of products sold, services rendered and for hygienic reasons, no refunds will be entertained on products already sold and dispatched, unless the incorrect product was dispatched.

If, for any reason you would like to cancel an order for a product or service, the cancellation will only be accepted in the event that you notify us of your intention to cancel prior to dispatch of the order in question or 24 business hours in the event of a service to be rendered. Any costs incurred as a result of the cancellation, including but not limited to banking or transfer costs, will be deducted from the refund amount. In the event of the non- or late cancellation of an appointment, the reserve the right to hold you liable for the full fees for the service and time booked.

Orders placed, paid for, and then cancelled (ie before being dispatched), will be refunded after deduction of a 10% charge for administration costs.

CHANGE IN TERMS AND CONDITIONS

These Terms and Conditions shall commence from the date on which they are published on the website and continue until amended by TSEDEQ™.

We reserve the right to amend, update, change or replace any part of the Terms & Conditions as we deem necessary. It is your responsibility to ensure that you remain updated with and fully understand the Terms & Conditions. Your continued use of or access to the website, following the updating of any changes, constitutes acceptance of those changes.

We further reserve the right to withdraw or amend any product, service (including full or part of the website) or information or restrict access to any part of the website without any notice. ORDERS AND DELIVERY

A delivery fee (as applicable) will be charged for each order placed by you and will be shown on the online invoice as a separate item. Delivery is free for orders exceeding R1500.00, however a courier fee applies to orders below R1500.00. We reserve the right to re-evaluate and make changes to these amounts from time to time as deemed necessary.

Orders collected from TSEDEQ™, will not incur any fee.

Note that no PO Box addresses will be accepted as a delivery address. It is your responsibility to ensure that someone will be present at the indicated delivery address provided to accept the delivery of your order.

Subject to stock availability with suppliers and receipt of payment, orders will be processed within 2 business days and then as per your selection, either kept for collection from TSEDEQ™ or handed over to the courier company for delivery.

Orders made on a weekend are only dispatched on the Monday.

Orders made before or on a public holiday are only dispatched the following working day.

Our aim is to have your order delivered to you within 3-5 business days (depending on the location being delivered to) from the date when the order was successfully paid for and processed, however it cannot be guaranteed. Once handed over to the courier company, we will advise you of the Courier company tracking number and contact details.

We will supply all products to the delivery company in good order.

We shall not be liable for any losses, liabilities, costs, damages, charges or expenses arising out of late or non-delivery of an order.

On receipt of the order, you may be required to sign for the parcel. You agree to inspect the parcel and product for any obvious faults, defects or damage before you sign for delivery. You need to keep the receipt of the delivered product in case of future discussions with us about it.

In the event of an incorrect delivery or defective product, please phone us on +27 82 931 0459 or email us at info@tsedeq.co.za, attaching a photograph of the packaging and defective product.

Note that it might not be possible for us to deliver to some locations. If this is the case, we will inform you, using the contact details that you provided to us when you placed your order, and arrange for cancellation of the order or delivery to an alternative delivery address should you so wish. Additional costs may apply.

We dispatch our products our standard packaging. Any special packaging requested by you, will incur an additional charges.

All risks in the product shall pass to you upon dispatch of the product. We will not be liable for any risk once the product has been correctly dispatched to you.

It is your responsibility to ensure that you are available or have made adequate arrangements to receive the package. Any costs incurred as a result of an unsuccessful delivery due to refusal from your side to accept the parcel or your non-availability, with the package being returned to us and/or resulting in a re-delivery, will be for your account.

In the event of an unsuccessful delivery as a result of non-availability on your side or non-collection of a product within 5 working days, we reserve the right to (without affecting any other right or remedy available to us)

1. charge you a storage fee and other costs reasonably incurred by us and/or
2. cancel the order, in which case we will refund you for the cost of the product (only), minus any costs incurred by us,

Any delivery or transactions fees are non-refundable.

SOUTH AFRICAN POST OFFICE DELIVERY (ONLY IF COURIER DON’T DELIVER TO YOUR AREA)

Should the courier service not deliver to your preferred and indicated address, we will with your consent, arrange for your order to be delivered (economy parcel) to your nearest local post office (as per the information provided by you) via the South African Post Office.

The processing and dispatch time on our side and conditions pertaining to delivery remain the same as for a courier service above. We cannot guarantee the delivery time. Note that delivery time may be influenced by customs clearance processes and requirements.

DISCLAIMERS OF WARRANTIES AND LIMITATION OF LIABILITY

We do not guarantee, represent, or warrant that your use of our website or services will be uninterrupted, timely, secure, or error-free.

We do not make any warranties or representations that the website shall be available at all times. ENTIRE AGREEMENT

FRAUD

TSEDEQ™ reserves the right, in the interest of preventing fraud, to refuse the processing of payment for any order and/or to cancel any purchase, partially or completely.

TSEDEQ™ may request documentation to complete the necessary fraud checks and cancel any order where the necessary documentation is not provided in a timely manner.

In the event of a fraudulent purchase being placed through the website, cardholders will be advised to initiate a chargeback via their bank in order to be refunded. TSEDEQ™ does not process refunds for orders suspected of fraud.

TSEDEQ™ does not disclose order details relating to orders suspected of fraud, unless legally obliged to.

GENERAL CONDITIONS

You understand that your personal content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. GIFT VOUCHERS

Gift Vouchers purchased through the TSEDEQ™ are valid for a period of three (3) years.

Due to annual price increases, the value of the Gift Voucher may deteriorate over the period.

Redemption of Gift Vouchers is subject to the TSEDEQ™ Terms and Conditions as well as making an appointment or availability of the specific products or services.

Gift Vouchers cannot be exchanged for cash nor will cash be given as change. Should the purchase value be lower than the voucher value, no change will be issued, nor can the remaining value be redeemed on another transaction, nor at another time. The voucher value must be redeemed in full as per the Terms and Conditions of the issuer.

Queries relating to an issued Voucher should be addressed with the TSEDEQ™ directly.

TSEDEQ™ Gift Vouchers are not redeemable for cash and will not be replaced if lost, stolen, destroyed, or used without permission. Gift Vouchers cannot be resold to- or exchanged with a third party. You cannot use a TSEDEQ™ Gift Voucher to purchase another TSEDEQ™ Gift Voucher. TSEDEQ™ Gift Vouchers can only be used for products or services offered through the website or in the salon, excluding the purchasing of other vouchers.

The TSEDEQ™ website and store is hosted by Hetzner/Xneelo. Hetzner/Xneelo provides us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through their data storage, databases, and the general hosting application. They store your data on a secure server protected by a firewall.

METHODS OF PAYMENTS

Products or services offered and rendered through the TSEDEQ™ website must be paid for through the online payment system.  Orders will only be processed once full payment have been made by you and confirmed to us by PayFast.

An item (product or service) placed in the shopping basket without competing the order does not amount to a sale or an order. The item(s) can therefore be moved from the shopping basket should the product not be available anymore or the price can change should there be a price adjustment during this time.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

We will debit the total value of your online order against the payment method tendered by you during the check-out process. Orders will be accepted and effected on payment prior to delivery of your order.

By submitting your order, relevant personal contact details and payment method you warrant that you are over the age of 18 (eighteen), are authorised to make payment with the payment method and that there are sufficient funds available to pay for the order.

If you choose a direct payment gateway to complete your purchase, then Hetzner stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discovery.

REFUNDS & RETURNS

Returns. Due to its nature and for purposes of safety, sanitation and hygiene, products or services sold or rendered may be not be returned nor will it be refunded or exchanged for another product or service. Refer the Cancellation of orders above, except for in the unlikely event of the wrong product being dispatched to you.

In the event of the wrong product dispatched to you, you agree to inform us in writing, accompanied by a copy of the delivery notice and a photograph of the product within 2 working days of the receipt of the product.

We will, on receipt of your email and within 2 working days dispatched the correct product to you at no cost to yourself, should the product still be available, if not we will refund you the full purchase price. The incorrect product will be collected at the same time as the delivery of the new product.

Note that in the event of a refund, you may experience a delay of between 10-14 working days in reflecting of the credit on your account.

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered, or destroyed.

TSEDEQ™ SHOP

Checkout, Order and Pay

After you have added your products to cart, proceed to the checkout. If any of the products selected in your cart is not available, this will display clearly in the checkout and you will be given the option to remove the particular item from your cart and replace it with another product (should you so wish).

Once you are satisfied with your order, you will be offered to choose between the delivery or collection option available.

Should you choose to have the product delivered to you, choose the option “Order, pay and deliver” or alternatively should you to collect the order, select the option “Orde, pay and collect”.

Confirmation

Once ordered and successfully paid for, you will receive a Confirmation of order and payment email sent to the email address provided by you.

Dispatch or collection of order

We will immediately start preparing your order for collection or dispatch as per your selection, as soon as we have received confirmation of successful payment.

Should you have opted for collection, you will receive an email confirming when your order is ready for collection.

Do not attempt to collect your order before the date as stated on the email sent to you as it will result in the order not being ready.

Once collected, check your order before you leave the salon.

Ordered Items will be held in for a maximum period of 5 working days from the time the email was sent. Non collection of the order may result in storage charges being levied.

Should you have opted for delivery, you will receive an email confirming that the order has been dispatched. The email will also contain the details of the courier company/post office (as applicable) and the track and trace number of the parcel.

We will notify you should there be any delay on dispatching the product, eg as a result of it being becoming out of stock.

REFUSAL OR TERMINATION OF SERVICE

 We reserve the right to refuse service, without prejudice to any other rights or remedies in law we may have, cancel forthwith any sale and/or your registration in the event of your breach any of the Terms & Conditions.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
